OWNERSHIP STATEMENT: The website mindplot.ai and the MindPlot service are owned and operated by Beijing COSINX Technology Co., Ltd., a corporation incorporated under applicable laws.
Please read these Terms carefully. By accessing or using MindPlot (the "Service")—whether through mindplot.ai, any sub-domain, API, mobile interface, or third-party integrations—you agree to be bound by these Terms of Service ("Terms") with Beijing COSINX Technology Co., Ltd. If you do not agree, you must not access or use the Service.
1. Acceptance of Terms
1.1 These Terms constitute a legally binding agreement between you and Beijing COSINX Technology Co., Ltd. ("COSINX", "we", "us", or "our").
1.2 COSINX may revise these Terms at any time. Material changes will be posted on mindplot.ai at least 7 days before they take effect. Continued use after the effective date constitutes acceptance.
2. Eligibility & Account Registration
2.1 You must be at least 18 years old (or the age of majority in your jurisdiction) and capable of entering into a binding contract to use the Service.
2.2 You may be required to create an account. You agree to:
- provide accurate, current, and complete information;
- maintain the security of your credentials; and
- promptly update any changes.
2.3 You are responsible for all activities that occur under your account. Notify us immediately at mindplot@cosinx.com of any unauthorized use.
3. Authentication & Security
3.1 Password-Free Authentication: MindPlot uses secure OAuth 2.0 authentication through trusted third-party providers (Google, Apple, GitHub). We never collect, store, or have access to your passwords. Your login credentials remain securely with your chosen authentication provider.
3.2 Data Security: Your personal and account data is protected by Supabase, a SOC 2 Type 2 certified platform with enterprise-grade security. All data is encrypted in transit and at rest using industry-standard protocols.
3.3 No Sensitive Data Collection: We do not collect credit card details (processed by Stripe/PayPal), social security numbers, or other highly sensitive personal information beyond what is necessary for service provision.
3.4 Your Security Responsibilities: While we implement robust security measures, you are responsible for maintaining the security of your third-party authentication accounts and promptly reporting any suspicious activity.
4. Description of Service
4.1 MindPlot provides AI-driven chat, brainstorming, and plotting tools ("AI Features"). Output may include text, images, diagrams, or other media.
4.2 The Service may integrate with third-party models (e.g., open-source LLMs) and is provided "as-is" and "as-available". We do not guarantee accuracy, completeness, or fitness for any particular purpose.
5. User Content & Intellectual Property
5.1 Your Content. You retain all rights in prompts, uploads, and any resulting outputs ("User Content") except for the rights granted to COSINX below.
5.2 License to COSINX. By submitting User Content, you grant COSINX a worldwide, non-exclusive, royalty-free, irrevocable license to host, store, reproduce, adapt, modify, translate, display, distribute, and otherwise use User Content solely to operate, improve, and provide the Service.
4.3 Public vs. Private.
- Public Projects: Choosing “public” allows other users to view, copy, and build upon your content under the license you specify (e.g., MIT, CC-BY).
- Private Projects: We will use reasonable measures to restrict access, but may access or disclose such content as required by law or to protect COSINX’s rights.
4.4 Prohibited Content. You agree not to upload or generate content that violates laws or rights, is harmful/abusive/obscene, or contains malware, spam, or phishing elements.
6. Acceptable Use & Compliance
5.1 No Misuse. You will not:
- reverse-engineer, decompile, or extract source code;
- circumvent rate limits or security features;
- use the Service to train competing models without prior written consent;
- deploy the Service in violation of export-control or sanctions laws.
5.2 Compliance Obligations for integrations include:
- complying with all applicable laws including GDPR, CCPA, and the EU AI Act;
- obtaining required consents for personal data processing; and
- performing risk assessments for high-risk use-cases.
7. Third-Party Services & Models
6.1 MindPlot may provide access to third-party models, datasets, or APIs (“Third-Party Services”). Your use of any Third-Party Service is governed solely by its own terms and licenses; COSINX disclaims all liability arising from such use.
6.2 You must review and comply with the license, attribution, and usage restrictions of each Third-Party Service you choose.
8. Fees, Billing & Refund Policy
Pricing & Billing
- 8.1 Portions of the Service may be offered free with usage limits; additional features require a paid subscription.
- 8.2 Pricing is posted on mindplot.ai and may change with 7-day notice for new subscriptions.
- 8.3 Paid plans are billed in advance via Stripe or PayPal. Billing cycles are monthly or annually as selected.
- 8.4 Delinquent accounts may be suspended or terminated; late fee up to 5% per month (or the legal maximum).
Refund Policy
- 8.5 7-Day Money-Back Guarantee: New subscribers may request a full refund within 7 days of their first subscription payment. Contact mindplot@cosinx.com with your account details.
- 8.6 Service Outages: If MindPlot experiences significant downtime (>24 hours), we will provide pro-rated credits or refunds upon request.
- 8.7 Mid-Cycle Cancellations: Subscriptions may be cancelled anytime, but no refunds are provided for partial billing periods except as stated above.
- 8.8 Annual Subscriptions: Annual plans may be refunded on a pro-rata basis within the first 30 days, minus any usage beyond the equivalent monthly plan limits.
- 8.9 Refund Processing: Approved refunds are processed within 5-10 business days via the original payment method. PayPal refunds may take 1-3 additional days.
- 8.10 Abuse Prevention: Accounts with excessive refund requests, charge-backs, or suspicious activity may be permanently suspended and ineligible for future refunds.
- 8.11 Legal Rights: This policy does not affect your statutory rights under applicable consumer protection laws.
9. Confidentiality & Data Protection
8.1 Each party shall keep confidential all non-public information disclosed by the other party.
8.2 Privacy. Our Privacy Policy (mindplot.ai/privacy) explains how we collect, process, and store personal data. By using the Service, you consent to those practices.
10. Termination & Suspension
9.1 You may delete your account and terminate these Terms at any time.
9.2 We may suspend or terminate immediately if you breach these Terms/law, pose a security risk, or we must comply with a legal order.
9.3 Upon termination, your access ends and we will delete or anonymize your User Content within 30 days except as required by law or to exercise our rights.
11. Disclaimers & Limitation of Liability
10.1 Disclaimer. THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND.
10.2 Limitation. TO THE MAXIMUM EXTENT PERMITTED BY LAW, COSINX SHALL NOT BE LIABLE FOR INDIRECT OR CONSEQUENTIAL DAMAGES; OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF USD 100 OR THE FEES PAID BY YOU IN THE PRIOR 12 MONTHS.
12. Indemnification
You agree to defend, indemnify, and hold harmless COSINX and its affiliates from claims arising out of your use of the Service, your User Content, or your violation of these Terms or any law.
13. Governing Law & Dispute Resolution
12.1 Governed by the laws of the State of Delaware, USA.
12.2 Disputes will be resolved exclusively in the state or federal courts; you consent to jurisdiction.
